More and more Americans have purchased long-term care insurance as the cost of nursing home stays increases – averaging almost $100,000 or more a year. Many people purchase long-term care insurance as part of their estate planning, hoping they will never need it but knowing they will rely on it to ease the burden of loved ones, if the need arises. Unfortunately, many insurance companies will wrongfully deny long-term care benefits, leaving your loved ones at a loss for what to do and how to cover the cost. If you are facing a denial, don’t let the insurance company bully you into accepting it and walking away. You can, and should, fight for the insurance proceeds that you paid for when you, or your loved one, purchased the policy.

Need Assistance Doing Activities of Daily Living or ADLs?

Under most policies, you qualify for long-term care insurance benefits where you need assistance with at least two activities of daily living (ADLs). Those six activities are:

  • hygiene,
  • dressing,
  • eating,
  • use of the restroom,
  • transferring and
  • walking.

For example, if you need assistance getting in and out of bed and using the restroom, you should qualify to receive the benefits of your long-term care insurance. Under most policies, an individual with a cognitive impairment should also qualify for benefits under long-term care insurance. The exact benefits you are entitled to will depend on the terms of your policy – if the insurance company denies your claim, it’s worth taking a second look at your policy to determine if the denial was wrongful.

Most long-term care insurance policies have a set amount of reimbursement per day – maybe $100 or $150 per day at a minimum. This allows the insured to afford the assistance of a caregiver helping with these activities of daily living. While this may seem like a small amount, the cost of long-term care adds up. It can add up to thousands of dollars a month, tens of thousands of dollars a year. It’s worth fighting a wrongful denial to preserve your assets and estate for yourself. You’ve paid for this insurance policy, don’t let the insurance company bully you into accepting the denial.

Understanding Requirements to Receive Benefits

If you need assistance with activities of daily living, be sure to look at your policy to understand the requirements to receive benefits. Does your policy allow a family member to be the caregiver or does it require a professional caregiver? Are you required to live in a facility to obtain benefits or can you receive benefits even if you live in your own home? If you are unaware of the terms of your policy, it could cause a denial – consult your policy before making a claim for benefits. If you’ve already made a claim and been denied, our attorneys, with over 50 years of combined experience, can help you fight the insurance company to get the financial help you need and deserve – you paid for it, after all.

“I’m sure you heard the news. Wow, what an experience! I was totally overwhelmed with the process, emotionally bankrupt. At the end of the day, I think I was in total shock. I wondered around in an emotional daze for hours. The good news, I woke up to a Brand New Day. I haven’t seen this kind of day in years. Just thought I would share that with you.

I also want to thank you for all your hard work. I know Michael could not have done what he did without you. You have been so valuable through this whole process. It is people like you that make people like me believe. Your work is impressive but, what I feel you represent as a human being is most impressive. I felt you holding my hand, and I am grateful to you for that. You are amazing. You were at the pulse of the case at all times. Not once did I feel that I needed to talk to Michael for clarification (a first for me, especially, in the legal world). You have been so helpful, and kind, and so supportive, and…

Thank you Nichole, for all you have done on my behalf. There are not enough words (at least in my vocabulary) to express my gratitude.” — RS
